Prayagraj: Chandrashekhar Azad, National President of the Azad Samaj Party and Member of Parliament from Nagina, has suffered a significant setback in the Allahabad High Court. A single-judge bench headed by Justice Sameer Jain on Wednesday dismissed Azad’s petitions seeking to quash criminal proceedings against him in connection with the Saharanpur violence case. The court had reserved its judgment on 27 November.
The case originates from a complaint filed by Sudhir Kumar Gupta at Saharanpur Kotwali Dehat police station, under IPC Sections 147, 148, 149, and 435. The trial is ongoing before the Special Judge-ADJ at the MP-MLA Court in Saharanpur. The High Court noted that it would not be appropriate to exercise its inherent powers to quash these proceedings or treat the related charge sheets as supplementary to the original FIR at this stage of the trial.
Allegations and Legal Arguments
Azad’s petitions argued that the second FIR filed in the matter was an abuse of law, claiming the incidents were similar. However, the court clarified that even if the events are similar, FIRs can be registered at different locations, and the police may file supplementary charge sheets. The allegations against Azad include serious charges such as bandh enforcement, property damage, and attacking a police station.
In total, Chandrashekhar Azad had filed four petitions seeking relief from the High Court. All four petitions were rejected, marking a major legal setback for the Nagina MP.
